Please read these Terms of Use ("Terms") carefully before using My Weight (the "App"). These Terms govern your access to and use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the App. By using the App, you represent that you meet this requirement. The App is intended for personal, non-commercial use only.
2. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal use. We reserve all rights not expressly granted to you.
3. Acceptable Use
You agree not to, and not to permit others to:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent such restriction is prohibited by applicable law
- Use the App in any unlawful manner or for any unlawful purpose
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or its related systems
- Use the App in any way that could damage, disable, or impair its functionality
4. Health Disclaimer
The App is a tool for tracking body weight and related personal measurements for general informational and self-monitoring purposes only. It is not a medical device and does not provide medical, nutritional, fitness, or other professional advice.
The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician or other health professional with any questions you may have regarding your health, weight, or any medical condition. Never disregard or delay seeking professional advice because of information obtained through the App. You use the App and rely on any information within it solely at your own risk.
5. Free Version and Advertising
The App may be offered in a free version supported by third-party advertising. The free version provides access to a limited set of features, and certain features, content, or functionality may be unavailable, restricted, or reduced compared to the paid versions. We may determine and change which features are included in the free version at our discretion.
By using the free version, you acknowledge and agree that advertisements may be displayed within the App. Advertising is provided by third-party networks, and we are not responsible for the content of any advertisement or for any products or services offered through them.
6. Subscriptions and Purchases
The App may offer paid options that unlock additional features and remove advertising, which may include:
- A monthly auto-renewing subscription
- An annual auto-renewing subscription
- A one-time purchase granting lifetime access (the "Lifetime Purchase")
The availability, content, and pricing of these options may vary and may change over time, and are displayed within the App or the applicable app store at the time of purchase.
Auto-renewing subscriptions: Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal through the applicable app store. You can manage or cancel your subscription at any time through your app store account settings; cancellation takes effect at the end of the current billing period.
All purchases and subscriptions are processed through the applicable app store (Apple App Store or Google Play). Payment, billing, and the processing of your transaction are handled by the relevant app store in accordance with its own terms and policies. We do not collect or store your payment card or other payment details. To confirm that a purchase or subscription is valid and to unlock the corresponding features, the App sends the purchase receipt or transaction information provided by the app store to our server, as described in our Privacy Policy.
Refunds, where available, are handled exclusively by the relevant app store under its applicable refund policy and are granted at the app store's discretion. We are generally unable to process refunds directly. Any refund request should be directed to the app store through which the purchase was made.
7. Meaning of "Lifetime" and Availability of the App
Any reference to "lifetime" access means access for as long as the App continues to exist and to be supported and made available by us. We do not promise or guarantee that the App, the service, or any specific feature will remain available indefinitely or for any particular period of time.
We reserve the right, at our sole discretion and at any time, to modify, suspend, limit, or discontinue the App, the service, or any feature thereof (including features previously made available through a Lifetime Purchase), with or without notice. This includes, without limitation, circumstances in which continued operation becomes technically, commercially, legally, or otherwise impractical. To the maximum extent permitted by applicable law, we will not be liable to you or any third party for any modification, suspension, limitation, or discontinuation of the App or any feature. Where a previously purchased feature is permanently discontinued, your sole remedy, if any, will be limited to that provided under the applicable app store's policies or by applicable law.
8. Your Data
Data you enter into the App, such as weight entries and optional profile information, is stored locally on your device. The App provides a feature to export your data to a backup file and to import it again; any exported file is created on and managed by you. You are responsible for maintaining and backing up your own data. We are not responsible for any loss, corruption, or deletion of data stored on your device or in any exported file, including loss resulting from uninstalling the App, device failure, or software updates. Our handling of information is further described in our Privacy Policy.
9. Intellectual Property
The App, including its design, features, text, graphics, and underlying software, and all associated intellectual property rights, are owned by the developer or its licensors and are protected by applicable law. These Terms do not grant you any rights to use any trademarks, logos, or other proprietary materials except as necessary to use the App as permitted.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, secure, accurate, or that it will meet your requirements or operate on any particular device or with any particular software. You assume the entire risk arising out of your use of the App.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of, or inability to use, the App, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising out of or relating to the App or these Terms shall not exceed the total amount you paid, if any, for the App or in-app purchases. Any refunds remain subject to the applicable app store's refund policy and are granted at the app store's discretion.
12. Termination
These Terms apply for as long as you use the App. We may suspend or terminate your access to the App at any time if you breach these Terms or if we discontinue the App. You may stop using the App at any time by uninstalling it.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes to the App or for legal, operational, or regulatory reasons. When we do, we will revise the effective date at the top of this document and, where appropriate, provide notice within the App. Your continued use of the App after such changes take effect constitutes your acceptance of the revised Terms.
